• Candidate: any person who submits their profile, joins the Talent Network or takes part in one of our recruitment processes.
• Client: a company that engages Productesas to find talent for one or more roles.
• Talent Network: our private network of Product professionals who have authorized us to consider them for opportunities.
• Content: the texts, designs, logos, methodologies, reports, templates and other materials available through the Services.

You must be at least 18 years old and able to enter into a binding agreement to use the Services. By using them, you confirm that you meet these requirements.

• We never charge candidates. Joining the Talent Network and taking part in our processes is free. Our fees are paid by Clients.
• Joining the Talent Network does not guarantee interviews, job offers or employment. We present candidates when we see a real fit, and every hiring decision belongs exclusively to the Client.
• We will never present your profile to a Client without first talking with you about the specific opportunity and getting your consent.
• Productesas LLC is not the employer of the candidates it presents, and it is not a party to the employment or services agreement signed between a Client and a candidate, unless expressly agreed in writing.
• We may decide, at our discretion, whether to include a profile in the Talent Network or move it forward in a process.

When you use the Services, you agree to:

• Provide information that is true, accurate and up to date, including your experience, education and work authorization.
• Only share third-party information (such as references) when you have their permission.
• Keep confidential any non-public information about Clients, roles or compensation that we share with you during a process.
• Not use the Services to send spam, impersonate others, scrape data, or attempt to access our systems without authorization.
• Not use our Content or databases for commercial purposes without our prior written permission.

We may remove a profile or end your participation if you breach these Terms or provide false or misleading information.

Our recruitment services for Clients (search scope, fees, guarantees, payment terms and confidentiality) are governed by a separate written agreement signed with each Client. If that agreement conflicts with these Terms, the Client agreement prevails.

• The Productesas and Productesas Recruitment Partners names, logos, Content and methodologies belong to Productesas LLC or its licensors and are protected by United States and international intellectual property laws.
• We grant you a limited, personal, non-exclusive and non-transferable license to view the Content for your own non-commercial use. No other rights are granted.
• You keep ownership of the materials you send us (such as your CV or portfolio) and grant us a license to use them only to provide the Services, as described in our Data Processing Authorization.

We process your personal data in accordance with our Personal Data Processing Authorization, which is part of these Terms.

The Services may rely on or link to third-party tools and websites (for example, Brevo, LinkedIn or scheduling platforms). We are not responsible for their content, policies or availability, and your use of them is subject to their own terms.

The Services and Content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the website will be uninterrupted or error-free, or any specific career or hiring outcome. Market insights, salary information and other Content are for general information and are not legal, financial or employment advice.

To the fullest extent permitted by law, Productesas LLC and its members, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or lost opportunities, arising from your use of the Services, from hiring decisions made by Clients, or from the conduct of any Client or candidate.

Because the Services are free for candidates, our total liability to you for any claim related to the Services will not exceed one hundred U.S. dollars (US$100). Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify and hold Productesas LLC harmless from claims, damages and expenses (including reasonable attorneys' fees) arising from false information you provide, your breach of these Terms, or your violation of the rights of others.

These Terms are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict of law rules. Before starting any legal action, you agree to contact us at recruitment@productesas.com so we can try to resolve the issue informally within thirty (30) days.

If it is not resolved, any dispute will be brought exclusively in the state or federal courts located in Collier County, Florida, and you and we consent to their jurisdiction. This does not limit any mandatory consumer or data protection right you have under the laws of your country of residence.

We may update these Terms from time to time. We will publish the new version on this page with its effective date and notify Talent Network members by email of material changes. You can stop using the Services and ask us to remove your profile at any time by writing to recruitment@productesas.com.

If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent. These Terms, together with the Data Processing Authorization, are the entire agreement between you and us regarding the Services.
