Productesas LLC, a Florida limited liability company ("Productesas", "we" or "us"), provides recruitment services specialized in Product Management roles through its Recruitment Partners service and Talent Network. Recruiting people means handling their personal information, and we take that responsibility seriously.
This document explains what personal data we collect, why, who we share it with, and the rights you have over it. By submitting your information through our forms (including the Talent Network application), sending us your CV, or taking part in one of our recruitment processes, you grant Productesas LLC your prior, express and informed authorization to process your personal data under the terms below.
01Data Controller
- Legal name: Productesas LLC
- Organized in: State of Florida, United States (Florida Division of Corporations, Sunbiz)
- Address: 12965 Positano Circle, Unit 202, Naples, FL 34105, United States
- Email: recruitment@productesas.com
- Website: productesas.com/recruitment-partners
Productesas LLC decides how and why your personal data is processed and is responsible for it. Productesas LLC is a sister company of the Productesas community; each entity is responsible for the data it collects under its own policy.
02Applicable law
This authorization is governed by the laws of the State of Florida and applicable United States federal law, including:
- The Florida Information Protection Act of 2014 (Section 501.171, Florida Statutes), which requires us to take reasonable measures to protect your personal information and to notify you in case of a data breach.
- The CAN-SPAM Act, which governs the marketing emails we send and guarantees your right to unsubscribe.
- The Fair Credit Reporting Act (FCRA), which applies if a background check is ever requested as part of a hiring process (see section 05).
Most of the people in our network live in Latin America and other countries. If the data protection law of your country of residence grants you additional rights (for example, Colombia's Law 1581 of 2012, Mexico's Federal Law on the Protection of Personal Data Held by Private Parties, Brazil's LGPD or the European Union's GDPR), we honor those rights as well. Nothing in this document limits a protection that the law of your country makes mandatory.
03Personal data we collect
Depending on how you interact with us, we may collect:
- Identification and contact data: full name, email address, phone and WhatsApp number, country and city of residence.
- Professional data: CV or résumé, LinkedIn profile, portfolio and other links, current role and company, years of experience, industries, skills, education, languages and work history.
- Job preferences: roles and seniority you are interested in, salary expectations, preferred work modality, availability, willingness to relocate, and work authorization or visa status.
- Recruitment process data: interview notes, assessments and case exercises, feedback from hiring companies, references (only with your consent), and the status of each process you take part in.
- Communication and technical data: our email and message history with you, email open and click metrics, IP address, device and browser data, and cookies.
04Purposes of processing
We use your personal data to:
- Evaluate your profile and include it in the Productesas Talent Network.
- Match your profile with open roles and contact you about opportunities aligned with your experience and preferences.
- Run recruitment processes: screening, interviews, assessments, coordination with hiring companies, offers and follow-up.
- Present your profile to a hiring company, only after talking with you about the specific role and getting your consent (see section 05).
- Contact the references you provide, only with your permission.
- Send you updates about the Talent Network, market insights and events. You can unsubscribe at any time.
- Produce aggregated and anonymized statistics (for example, salary benchmarks or talent market reports) in which you cannot be identified.
- Answer your requests and comply with our legal, accounting and contractual obligations.
We do not sell your personal data, and we do not use it for purposes unrelated to recruitment and career opportunities.
05Sharing your profile with hiring companies
Your information will never be shared with a company without a prior conversation and your consent for that specific opportunity. Before we present you, we will tell you the company (or a description of it, when confidential), the role and the main conditions, and you decide whether to move forward.
Once you agree, we share only what the process needs (typically your CV, professional profile, our assessment and your expectations). Hiring companies receive your data to evaluate your candidacy and are expected to use it only for that purpose.
We do not run background checks or obtain consumer reports about you. If a hiring company requires one, it will only happen with your separate written authorization and the disclosures required by the Fair Credit Reporting Act.
06Sensitive data and minors
We do not collect sensitive data as a general rule. If we ever ask for it (for example, in a voluntary diversity survey, or to arrange accessibility accommodations for an interview), answering is completely optional, it will never affect your candidacy, and we will ask for your explicit consent first.
Our services are intended for people aged 18 or older. We do not knowingly collect data from minors.
07Service providers and international transfers
We rely on trusted technology providers to operate (for example, Brevo for forms and email, plus cloud storage, CRM, applicant tracking, scheduling and video call tools). They act as data processors on our behalf, under confidentiality and security obligations.
Productesas LLC is based in Florida, United States, and our providers and hiring companies may be located in the United States, the European Union, Latin America or other countries. By granting this authorization, you agree that your data may be transferred to and processed in those countries, always with reasonable safeguards and only for the purposes described here.
08Your rights
As the owner of your personal data, you have the right to:
- Know, access and get a copy of the personal data we hold about you, free of charge.
- Update or correct inaccurate or incomplete data.
- Request proof of the authorization you granted.
- Be informed about how your data has been used and who it was shared with.
- Revoke this authorization and ask us to delete your data, unless a legal or contractual duty requires us to keep it.
- Opt out of marketing communications at any time, using the unsubscribe link in any of our emails.
- File a complaint with the Florida Office of the Attorney General, or with the data protection authority of your country (for example, the Superintendencia de Industria y Comercio in Colombia).
09How to exercise your rights
Write to recruitment@productesas.com with your full name, the email you used with us, and a clear description of your request. We may ask for additional information to verify your identity.
We will answer questions within ten (10) business days and complaints or deletion requests within fifteen (15) business days from the day after we receive them. If we need more time, we will let you know why and when you will hear from us.
10Data retention
We keep your data while you are part of the Talent Network or an active recruitment process, and for up to five (5) years after our last interaction so we can keep considering you for new opportunities. After that, we delete or anonymize it, unless you ask us to keep it, ask for earlier deletion, or the law requires us to retain it longer.
11Security
We apply reasonable technical, administrative and organizational measures to protect your data against loss, misuse and unauthorized access, including access controls, encrypted platforms and confidentiality agreements with our team and providers, as required by the Florida Information Protection Act.
If a security breach ever affects your personal information, we will notify you without unreasonable delay and no later than thirty (30) days after determining that the breach occurred, and we will notify the Florida Department of Legal Affairs when the law requires it. When we no longer need records containing your personal information, we dispose of them securely.
12Changes to this document
We may update this authorization from time to time. We will publish the new version on this page with its effective date, and we will notify you by email of any material change before it takes effect.
13Your authorization
By checking the authorization box in our forms, or by sending us your information, you declare that:
- You have read and understood this document.
- You are 18 years of age or older.
- The information you provide is true, and you have the right to share any third-party information you include (such as references).
- You freely authorize Productesas LLC to process your personal data for the purposes described above, including international transfers.
- You understand this authorization is governed by the laws of the State of Florida, without prejudice to the mandatory data protection rights of your country of residence.
You can revoke this authorization at any time by writing to recruitment@productesas.com.
